Refund policy

Return & Cancellation Policy – Pharmabinoid B.V.

This Return & Cancellation Policy forms an integral part of our Terms & Conditions. It governs the cancellation, return, and refund process for all orders placed with Pharmabinoid B.V.

1. Business Buyers

1.1 We sell by default on a business-to-business (B2B) basis.

1.2 Business Buyers have no legal right to cancel or return any order, including Stock Items and Custom Goods, unless explicitly agreed in writing or covered under the TryPharma Guarantee (see section 5).

2. Custom Goods

2.1 Custom Goods
Any goods that are not available for purchase on the webshop at the time you place your order and are therefore sourced, produced, filled, re-packed, or otherwise prepared specifically on request. This may include (without limitation) oils, e-liquids, vapes, cosmetics, gummies, distillates, and extracts.

2.2 This includes but is not limited to: Oil, E-liquids, Vapes, Cosmetics, Gummies, Distillates, Extracts.

2.3 All orders for Custom Goods are final and cannot be cancelled or returned once production, procurement, or repackaging has commenced.

2.4 This policy applies to both business and consumer customers.

2.5 Under Article 16(c) of Directive 2011/83/EU, consumers have no statutory right of withdrawal for goods made to their specifications or clearly personalized.

3. Consumers – Stock Items

3.1 If you qualify as a consumer under Article 2(1) of Directive 2011/83/EU, and your national law implements this Directive, you have the right to withdraw from a contract for Stock Items only, under the following conditions:

  • You must notify us of withdrawal within 14 calendar days of delivery (Article 9).

  • The goods must be unopened, unused, and in original packaging.

  • Return shipping is at your own expense.

  • You are responsible for diminished value caused by handling beyond what is necessary to inspect the goods (Article 14(2)).

  • You have no right of withdrawal where Article 16 exemptions apply, including:

  • Article 16(c): Goods made to the consumer’s specifications or clearly personalized.
  • Article 16(d): Goods liable to deteriorate or expire rapidly.
  • Article 16(e): Sealed goods not suitable for return due to health protection or hygiene reasons, if unsealed after delivery.

3.2 Refunds, if applicable, will be issued within 14 calendar days of receiving the returned goods or proof of return shipment (Article 13(1)).

4. Abandonment Procedure (Seizures & Import Refusals)

4.1 If your shipment is seized, delayed, or refused by customs or regulatory authorities at the destination:

  • You must notify us within 3 business days of the event.

  • If return shipment is possible and lawful, you may instruct us to accept and restock the goods (Stock Items only).

  • All fees, penalties, and logistics costs are your responsibility.

  • If return is not possible, or no instruction is received, we will deem the goods abandoned and no refund will be issued.

5. TryPharma Guarantee (Promo Code TRY30)

5.1 The TryPharma Guarantee is a voluntary, opt-in return program for Stock Items.

5.2 It only applies if the promo code TRY30 was entered at checkout.

5.3 Under this program, you may return eligible Stock Items within 30 calendar days of delivery for a full refund or store credit, under the following conditions:

  • The item is unopened, unused, and in resaleable condition.

  • You return it at your own cost.

  • The product is not exempt under Article 16 of Directive 2011/83/EU.

5.4 This guarantee does not apply to Custom Goods.

6. Return Merchandise Authorisation

6.1 All returns require prior written authorisation.

6.2 Unauthorised returns may be rejected or disposed of at your cost.

6.3 Returns must be sent to the address we provide, with appropriate documentation and tracking.
